Auction Participation and Sale Terms
These terms govern timed online auctions operated by Ana Art. Read them before authorizing a card or placing a bid.

Scope, language, and eligibility
These terms apply to online auctions on this website. You must be at least 18 years old, have legal capacity to contract, use a verified account, and provide accurate details. The terms are available in every supported website language; mandatory consumer law prevails if a translation differs.
Artwork and condition
Each lot page identifies the artwork, artist, dimensions, medium, images, starting bid, currency, auction period, and material information known to us. Images may display differently by screen. Review the lot and ask questions before bidding; this does not limit statutory conformity rights.
How the auction works
The page shows the opening and closing time, current bid, minimum next bid, and minimum increment. Server time controls. Before submission you can review and correct the amount. A bid is recorded only after the website confirms acceptance. Your account lists active bids and payment deadlines.
Binding bids and contract formation
The button marked “Place binding bid” submits a legally binding offer. A bidder may not bid against their own leading bid. The highest eligible bid recorded when the auction closes wins. The sale contract is concluded when the system closes the auction and records that bid as the winning offer, subject to mandatory law and any fraud or technical review described below.
Closing extensions and technical incidents
A valid bid placed within the displayed anti-sniping period extends the closing time by that period. If a material outage, duplicate event, data error, unauthorized activity, or obvious pricing error affects fairness, we may pause, extend, correct, or cancel the affected auction and will document the action.
Card verification hold
Before bidding, Stripe may place the displayed temporary authorization hold on your card. It verifies bidding eligibility; it is not payment for the artwork and this website does not capture it as the purchase price. Ana Art does not store full card data. We request release after the relevant auction or sooner when required, but the card issuer controls when a pending amount disappears.
Price, shipping, taxes, and payment
The winning bid is the artwork price. No buyer’s premium is charged unless one is clearly disclosed before bidding. Shipping is calculated separately from the destination and shown before payment. Import VAT, customs duties, or brokerage charges imposed by the destination may be payable by the buyer. The winner must pay through Stripe within the displayed payment window.
Missed payment and next bidder
If payment is declined, canceled, or not completed by the deadline, we may cancel the winner’s purchase and offer the artwork to the next eligible bidder at that bidder’s own recorded bid. A card verification hold is never used as a substitute payment under the current auction process.
Delivery, damage, and risk
We dispatch to the confirmed address using the shipping service shown before payment. Estimated delivery dates are not guarantees. Risk passes as required by applicable consumer law. Report transit damage promptly with the packaging and photographs so that we can investigate with the carrier.
Consumer withdrawal and returns
Because these auctions are online-only and do not allow in-person attendance, they are not treated as a “public auction” for the EU consumer-withdrawal exception. Where EU/EEA/UK distance-selling rules apply, a consumer may generally withdraw within 14 days after receiving a standard artwork. Valid exceptions can apply to commissioned, made-to-specification, or clearly personalized work. To withdraw, send an unambiguous statement identifying the buyer and order to the contact above. The buyer pays direct return costs unless stated otherwise; statutory refund timing and permitted deductions for handling apply.
Conformity, complaints, and refunds
Mandatory rights relating to defective, damaged, or misdescribed goods remain unchanged. Contact us with the order or auction reference and evidence of the issue. Approved refunds are returned through the original payment method.
Fair use and enforcement
Automated bidding abuse, account sharing, false identities, collusion, manipulation, payment fraud, and interference with the service are prohibited. We may reject affected bids, suspend access, or cancel an auction where reasonably necessary, without limiting rights already created under mandatory law.
Privacy and auction evidence
The public bid history shows the bidder alias, bid amount, time, and country inferred from the bid IP. Exact IP addresses, forwarded-IP data, account identifiers, consent evidence, and Stripe references remain private and are used for security, audit, dispute handling, and legal compliance. The Privacy Policy explains retention and data rights.
Intellectual property
Buying an artwork transfers ownership of the physical work only. Copyright, reproduction, publication, merchandising, and other intellectual-property rights remain with their holder unless expressly transferred in writing.
Liability, law, and changes
Nothing excludes liability or consumer rights that cannot legally be excluded. These terms are governed by the laws of Poland, while consumers retain mandatory protections of their habitual residence. Complaints may be taken to a competent court or available consumer ADR body. We may change terms for future authorizations only; the version accepted for an existing authorization remains recorded and reproducible.
